Privacy Policy – TouchVue & SnapVue

INTRODUCTION

This policy describes how the mobile applications TouchVue and SnapVue (‘app’ or ‘apps’) process your personal data (‘data’) and the role ARC INFORMATIQUE plays to ensure your data privacy. This policy is meant to help you understand what personal information the apps use and collect, why the apps collect them and how they may be shared. It is also a guide to help you exercise your rights and controls over your personal data.

PREAMBLE

While this preamble may look unusual in a privacy policy, transparency is key, and it is important for you as an app user to understand that we ARC INFORMATIQUE do not operate the server to which you connect to with the apps. And because we do not operate the server, we do not process your personal data. The only exception is when the notification feature is in place on a server you connect to (more information in section DATA SHARED WITH THIRD-PARTY).

In all other cases, any personal data transmitted by the apps are processed under the responsibility of the backend server licensee (‘licensee’ or ‘backend licensee’), based on its own policy and procedures.

ARC INFORMATIQUE is a publisher of software solutions designed for monitoring and control of automation systems in various industries such as buildings, infrastructure, energies, transportation.

The product portfolio of ARC INFORMATIQUE includes software, namely PcVue and its derivatives, capable of collecting, processing, analyzing, displaying and transmitting data. It enables users to access information about the process, assets, and operations of an entity, which is generally the licensee of the said software packages.

ARC INFORMATIQUE grants the right to use PcVue or its derivatives to companies or entities in accordance with an end-user license agreement that allows for a variety of features and deployment scenarios, including server components, desktop applications and web & mobile applications.

In any case, the use of such software solutions requires the signing of a contractual agreement between ARC INFORMATIQUE or any company belonging to ARC GROUP, and the beneficiary entity (the licensee) or any other person acting in the name of and/or on behalf of the said entity, whose terms and conditions shall be respected.

Subject to the provisions of the said contractual agreement, mobile applications can then be made available to its users by the licensee of the server components who installs, configures, deploys and operates the server infrastructure and software under its own responsibility.

This policy is not the General Conditions of Use of the apps, which is a separate document. The General Conditions of Use outline the legal contract between you and ARC Informatique for using the apps.

You are eventually bound to operational rules and procedures established by the server licensee who provided you with credentials to connect the apps to its server(s). These rules and your credentials are not under the control of ARC INFORMATIQUE, and we deny any liability related to them.

DATA COLLECTION AND PROCESSING

The apps TouchVue and SnapVue require the use and collection of data as part of their core features. The Apps are not designed to collect data for a reason other than apps functionality. Some data are only used locally on your device, others are transmitted off device to the backend server operated by the licensee. ARC INFORMATIQUE does not access, collect, use, or sell any of said data.

Data required:
Personal info – User IDs : This data is essential for authentication purpose, which is required to access other features of the apps, and for traceability of the actions you perform on the operated automation system. It is transmitted off device to the backend server operated by the licensee.

Optional data:
By design of the apps, no other data collection is required. Optional data includes location, in-app messages, photos, videos, and other files that are not essential for using the apps but may enhance the user experience and effectiveness of operations. Depending on the backend server configuration and the licensee operational procedures, data may have to be collected for the user to fulfill his/her duties.

Users have the option to opt-in or opt-out providing optional data. Location and Device IDs are used and transmitted to the server in background. It is possible to opt-out by disabling the corresponding permissions. Other data are only used and transmitted to the server when the user takes advantage of the corresponding feature in the app.

DATA SHARED WITH THIRD-PARTY

Support for notification is based on the Firebase service, hosted on an infrastructure operated by Google, and used under the responsibility of ARC INFORMATIQUE. When taking advantage of this app feature, the Device ID and Firebase installation ID are transmitted to the backend server and shared with the Firebase service. The Firebase service does not use these IDs for any purpose other than providing the notification service and by ARC INFORMATIQUE to fulfill its contractual obligations towards the backend licensee.

We may preserve, use, share, or disclose your information if we believe that it is reasonably necessary to comply with a law, regulation, legal process, or governmental request; protect the safety of any person, protect the safety or integrity of the platform, including to help prevent spam, abuse, or malicious actors on our services; address fraud, security, or technical issues; or protect our rights or property, or the rights or property of those who use our services.

DATA SECURITY

The data provided by app users, including automatically collected data and optional data is processed and stored on a server operated under the responsibility of the backend licensee. ARC INFORMATIQUE is not responsible for the security and safety of any information collected by the backend server. We encourage licensees to adhere to stringent data protection standards in line with industry best practices. Licensees are required to implement technical and organizational measures to safeguard the confidentiality and security of user data. These measures include but are not limited to encryption, access controls, and regular security audits.

DATA RETENTION

The data provided by app users, including automatically collected data and optional data is processed and stored on a server operated under the responsibility of the backend licensee. The data retention policy is that of the backend licensee. Because the apps are designed for monitoring and control of automation systems, the data retention policy of the licensee usually accounts for the need to log, trace and archive user activity and commands.

REQUEST ACCESS AND DELETION

Because the data provided by users, including automatically collected data and optional data, is processed, and stored on a server operated by the backend licensee, app users are advised to first contact the licensee directly to exercise their data access and modification rights.

App users can initiate requests to access or modify their data by reaching out to the licensee’s designated point of contact or support team. The licensee is responsible for facilitating these requests in accordance with their established procedures and applicable data protection laws and regulations.

The app does not offer account creation. Accounts are created, managed, and deleted from the backend system under the responsibility of the licensee. Therefore, the app does not offer the possibility to delete a user account. If you want your account to be deleted, reach out to the licensee’s designated point of contact or support team.

ARC INFORMATIQUE requires backend licensees to ensure that users’ data access and modification rights are respected and upheld. We provide support and guidance to licensees to ensure they implement appropriate measures to facilitate user requests effectively.

PRIVACY POLICY UPDATES

As part of our commitment to transparency and user trust, we may update our privacy policy from time to time. Any changes made to the privacy policy will be communicated directly to users through an in-app prominent notice.

We encourage users to review the updated privacy policy to stay informed about how their data is collected, used, and protected. Users have the opportunity to ask questions, provide feedback, or seek clarification regarding the updated privacy policy through the designated point of contact provided in section CONTACT.
